
A murder defendant who sought to withdraw his guilty plea just before sentencing last year in the fatal shooting of a Miami Twp. hotel worker is set to return to court today.
Larry Malcolm Sain, 18, was scheduled to be sentenced in September after pleading guilty in the Sept. 13, 2018, shooting of Jayren Graham, 18, of Miami Twp., outside the DoubleTree Suites by Hilton off Ohio 741 near the Dayton Mall.

But Sain abruptly changed his mind minutes before Montgomery County Common Pleas Court Judge Barbara Gorman was expected to sentence him to 18 years to life in prison, the bargain prosecutors said he made for pleas of guilty to murder and tampering with evidence.
Sain’s initial defense attorney, Patrick Mulligan, is no longer representing him and the defendant waived attorney/client privilege with Mulligan in December when he testified at a hearing.
Sain testified in conflict with earlier witnesses and said the 2018 fatal shooting was in self-defense, a strategy he said Mulligan never mentioned to him.
